SCOPE

These General Terms and Conditions (hereinafter referred to as “General Terms”) describe the legally binding conditions of the services and information on the kitten adoption website: www.purrs.bg/kittens and/or www.purrs.com/kittens (the “Website”), part of www.purrs.bg and/or www.purrs.com/kittens and the application “Purrs Go”, available on Google Play and Apple App Store (the “Application”) — collectively referred to as “Platforms”, owned by PURS Foundation (“PURS”, “We”).

We assume that if you use the Platforms, starting from your first visit to the Website and/or installation of the Application, you are familiar with the content of this document. By using the Platforms, you agree to comply with these General Terms, which are applicable from your first visit to the Website and/or installation of the Application.

We reserve the right to periodically update and modify its content, the current version of which is always available on the Platforms.

DEFINITIONS

Application	the application “Purrs Go”, available on Google Play and Apple App Store;
Platforms	The Website and the Application;
Content	text, descriptions, graphics, logos, photos, (moving) images and/or illustrations available on the Platforms, including the respective source codes, designs, updates, techniques, and methods, etc., used for the construction and maintenance of the Application;
PURS	PURS Foundation, administrator of the Platforms;
User	user within the meaning of the Consumer Protection Act and the Act on the Provision of Digital Content and Digital Services and the Sale of Goods, as well as all interested parties, visitors, and users of the Platforms;
Organization	legal entity or other legal formation;

MESSAGES

In connection with the use of the Platforms, we may send you announcements, notifications, updates, and messages of a technical and administrative nature if you are registered and/or have provided an email address on the Platforms.
You will receive these messages at the email address provided during account registration, respectively during the application for a published advertisement on the Website.
We may send you notifications to the specified email address regarding current services if you have subscribed to this service.

INTELLECTUAL PROPERTY

The content available on the Platforms is subject to copyright, protected trademarks, and/or other intellectual property rights and is owned by PURS, its licensors, business partners, and/or suppliers.
The content of the Platforms may only be used for the intended purpose for which it is provided and solely in connection with the services we offer through them, including the right to use the Application, its storage.storing in the memory of your device, loading, executing, and displaying.
You do not have the right, without prior written permission from PERS, to copy, modify, alter, publish, distribute, forward, sell, or transfer, in whole or in part, any Content for commercial purposes, unless otherwise specified in applicable legislation.
You have the right to view, use, print, and download Content from the Platforms only for personal, informational, and non-commercial purposes, in which case the Platforms must be explicitly cited as the source of this information. You do not have the right to use the name and trademarks of PERS without our prior consent.
Content generated and uploaded by you on the Platforms will not be considered a protected subject of intellectual property.
In cases where the conditions of the previous point do not apply, by voluntarily publishing it through/on the Platforms, you grant us the right to use, store, adapt, copy, and distribute the content and to provide it to third parties, including various portals and/or social networks other than the Platforms.

LIMITATIONS OF LIABILITY

The Platforms may contain inaccuracies and typographical errors. We reserve the right to change, correct, and/or improve the current content without prior notice.
You bear personal responsibility regarding the information you record, store, structure, and/or disclose in and/or through the Platforms, as you are obliged to comply with the following Rules of Conduct.
We are not responsible for malfunctions, damage, data loss, or errors in the content of the Platforms that may arise directly, indirectly, or accidentally, and which are related to establishing a connection, visualizing, or downloading content from the Platforms. You are responsible for configuring your devices and software in a way that allows you to have full access to the Platforms.
We may temporarily or permanently suspend or restrict access in whole or in part to the Platforms for operational and technical reasons without notice when necessary.
The Platforms may contain hyperlinks to other web pages and to sources provided by other users of the Platform. PERS has no control over the content of these web pages or sources.

ACCESS AND REGISTRATION

The content of the website is freely accessible for viewing by anyone.
Account registration is voluntary and free, and it is only necessary for using certain functionalities of the Platforms, including the ability to publish, respectively to apply for adoption announcements for kittens through the Platforms. Account registration for Organizations is mandatory for using the services of the Application.
The following requirements apply to the registration of the website:
- To register on the website, each User must be at least 16 years old.
- To register on the website, each Organization must be a non-profit association or a commercial company registered under Bulgarian legislation or under the legislation of another member state of the European Union, or of another state party to the Agreement on the European Economic Area, or of the Swiss Confederation.
For successful registration, you must provide a valid email address for identification (username) of the account in the registration form and choose a password of your choice.
By registering, you agree that all activities performed from the registered account, including but not limited to, viewing the Content of the website, publishing announcements or applying for published announcements, sending emails, using the chat function on the Platform, and other electronic communication, will be considered asmade and/or authorized by you.
By registering an account to purchase Goods, you declare that:
- you are a natural person at least 16 years old, or you are a representative of an Organization that meets the requirements of section 17.2.;
- the information provided by you is accurate, current, and complete.
You are responsible for:
- maintaining the confidentiality of your username and password.
- all activities carried out through your account and/or password.
- any misuse of the account by third parties, to the extent that you can be held liable.
- the accuracy, currentness, and completeness of the information you provide. If you become aware of any misuse or unauthorized use of your username, password, and/or registered account, you must immediately inform us.
Reserves the right to restrict or terminate accounts, to remove or edit Content at its discretion, as permitted by law.

RULES OF CONDUCT

You may not use the Platforms and the services offered therein to:
- copy the Platforms, unless such copying occurs automatically for the normal use of their Content;
- provide to third parties, translate, merge, adapt, change, or modify in whole or in part the Content in the Platforms or the Application itself;
- decompile or create derivative products based entirely or partially on the Content in the Platforms and/or from the Application;
- use the Platforms in a way that may overload or disrupt their functioning and information security and/or that of other users;
- impersonate another natural or legal person, including a representative of PERS;
- for the purpose of transmitting or sending unsolicited advertising or other promotional messages.
You may not use the Platforms and the services offered therein:
- in a manner that violates applicable law or is related to an illegal purpose or fraud, or leads to fraud;
- to harm, attempt to harm, or otherwise violate the legal rights of third parties;
- to create a database by saving content from the Platforms;
- to intentionally transmit data, send or upload materials that contain malicious software;
- to gain unauthorized access to the Platforms, to the server on which the information is stored, or to any other server, computer, or database related to them.
You may not upload and/or distribute content through the Platforms and the services offered therein that:
- contains obscene and/or offensive materials and materials that express hatred, promote violence, discrimination, or other violations of the law, contain threats and insults, or defame or discredit third parties;
- contain pornographic materials;
- violate copyright and related rights, database rights, or trademark rights of any person;
In case of violation of the rules of this section, we have the right to:
- edit or delete content published by you and/or restrict access to it, including access to your profile in the Platforms;
- notify the relevant law enforcement authorities;
- take other actions we deem appropriate.

PERSONAL DATA PROTECTION

PERS may collect, use, store, or otherwise process personal data when visiting, registering an account, and/or using the Platforms.

DISPUTES. APPLICABLE LAW AND JURISDICTION

Bulgarian legislation governs the relationships to which these Terms apply, including in relation to any disputes arising between them.
When a dispute arises that is not resolved voluntarily, the User may:
- refer the dispute for Alternative dispute resolution such as:- visit the official page of the European Commission for online dispute resolution, available here.
  - initiates the formation of a mediation commission at the Consumer Protection Commission.
- file a complaint with the Consumer Protection Commission in person or online on its website.
- file a complaint with the competent Bulgarian court.
